I. Introduction

Our Privacy Policy provides information on how Nexxus Portal collects, uses, and protects personal information. Nexxus Portal is committed to the highest standards of protection for personal data at all times. When we refer to “us,” “we,” “our,” or “Nexxus Portal” in this Privacy Policy, we are referring to Nexxus Portal and its affiliates.

Our Privacy Policy governs all the manners in which Nexxus Portal collects personal information directly from you as a user. How we collect information and how we use information may differ based on how you interact with the Nexxus Portal.

If you are an end-user (parent, teacher, or administrator) of our customer (a school or school district) and you are using Nexxus Portal services through our customer (your school or school district),we are considered a “data processor”. In these cases, your school or school district’s privacy statement or privacy notice governs the use of any personal information. Our Privacy Policy does not supersede the terms of any agreements between us and school or school districts, nor does it affect the terms of any agreement between the parent and the parent’s school or school district. 

II. What Information We Collect and How We Use It

The nature of the personal information we collect and how we use it depends on the context in which we collect that personal information. Please see the section below that applies to you.

When we hire third parties to perform certain business-related functions for us. For example, we sometimes hire third parties for mailing information, maintaining databases, hosting services, processing payments, and generally to support our operations. When we employ another company to provide services to support Nexxus Portal, we provide them only with the information that they need to perform their specific function. Our third-party providers are legally obligated to keep your personal information confidential. Our third-party providers also are required to maintain reasonable security practices, to use the information only for the purpose that we prescribe, and to prevent disclosure of the information to unauthorized parties. 

A. Customers (Schools and School Districts)
If you are a customer of Nexxus Portal, we are providing our products and services directly to your school or school district and we are a “data controller” for purposes of the personal information collected in connection with the customer accounts.

Information We Collect
Directly from you. We collect only the information necessary to provide the educational technology services as directed by you. Where possible, we limit the amount of data transfers. We may collect employee account information including user names, email addresses and titles to initially set up products and services for you.

How We Use This Information
We use your information to provide you the features and functionality of the Nexxus Portal. We do not provide any user data or personally identifiable information to anyone for marketing purposes.

B. Parents
This section is provided for informational purposes and describes how parent’s personal information is used. How that information is used also depends on the school or school district, so please also consult your institution’s privacy statement.

Information We Collect
Information provided to us by parents would includes but is not limited to: name, email address, and phone number. 

Indirectly from a parent: We may collect device and usage information when you access and use Nexxus Portal products and services, including information that your browser or the mobile app sends when you are using it. This data may include your unique device identifier, IP address, your browser type and configuration, the date and time of your use of the product or service.

How We Use This Information
We use the information in accordance with our agreement with your school or school district to operate, maintain, and provide the features and functionality of the Nexxus Portal.

How We Share This Information
We do not share your information to any third party under any circumstance. However, our technical and client support teams may have access to personal information when software or other changes are required for support and maintenance purposes.  

III. Data Retention
We keep information collected on behalf of our customers for as long as necessary. We dispose of information that is not held pursuant to contractual terms at the request of a customer. 

We want you to have access to your information, so that you can help keep it as accurate as possible. If you register and provide Nexxus Portal with Personal Information, you may update, correct, or delete your account and information at any time by reviewing your profile information and preferences on your account settings page. 

Nexxus Portal will work with Schools to provide parents access to information in School User accounts at the request and direction of the School. If you experience any difficulties in this process, please contact us as described below. 

To request deletion of your personal information and/or videos, send an email to support@coffeechatnetwork.io setting forth your request. You can learn more in our Help Center or on the profile page at nexxusportal.com/app/my space/profile. Please note that your information will be retained in backup for up to one week.

IV. Children’s Privacy
We do not collect any information from children. 

V. Security
Nexxus Portal employs a variety of physical, administrative, and technological safeguards that are designed to protect personal information against loss, misuse, and unauthorized access or disclosure. We strive to continuously enhance our technical and operational security measures. Our measures consider the type and sensitivity of the data being collected, used, and stored, and the current state of technology and threats to information.  

If Nexxus Portal becomes aware of a systems security breach by an unauthorized party or that any user data was used for an unauthorized purpose, we will comply with relevant state and other data breach laws. We will notify users of any breach resulting in unauthorized release of data electronically, at minimum, and without unreasonable delay so that you can take appropriate steps. The notification will include: date of the breach, the types of information that were subject to the breach, general description of what occurred, and steps Nexxus Portal is taking to address the breach.

VI. Links to Other Sites
Users may provide links to third party websites or resources through the Nexxus Portal. The information practices of those websites are not covered by this Privacy Policy. 

VII. Changes to This Privacy Policy
Nexxus Portal may modify or revise this Privacy Policy from time to time. Nexxus Portal will notify users of any changes to our Privacy Policy by posting the revised Privacy Policy with an updated date of revision on our Service. If we change this Policy in a material manner, we will do our best to notify you of the changes by posting a notice on our website and via email contact information we have on file. Your continued use of the Services following the effective date of such update constitutes your acceptance of the revised Policy.

VIV. Change of Control
Over time, Nexxus Portal may grow and reorganize. We may share your information, including personal information with affiliates such as a parent company, subsidiaries, joint venture partners or other companies that we control or that are under common control with us, in which case we will require those companies to agree to use your personal information in a way that is consistent with this Privacy Policy.

In the event of a change to our organizations such that all or a portion of Nexxus Portal or its assets are acquired by or merged with a third-party, or in any other situation where personal information that we have collected from users would be one of the assets transferred to or acquired by that third-party, this Privacy Policy will continue to apply to your information, and any acquirer would only be able to handle your personal information as per this policy (unless you give consent to a new policy). We will provide you with notice of an acquisition within thirty (30) days following the completion of such a transaction, by posting on our homepage and by email to your email address that you provided to us. If you do not consent to the use of your personal information by such a successor company, subject to applicable law, you may request its deletion from the company. 

In the unlikely event that Nexxus Portal goes out of business, or files for bankruptcy, we will protect your personal information, and will not sell it to any third-party.
